Separation
There are three main options open to couples wishing to separate:
1. Deed of Separation
This may be appropriate for couples wishing to live apart but who may not want to proceed with a divorce at this stage.
2. Judicial Separation
This is similar to a divorce process but the couple remain legally married.
3. Divorce
If the marriage has irretrievably broken down divorce proceedings can begin.
The five grounds for divorce are adultery, unreasonable behaviour, separation lasting two years or more - with mutual consent, separation lasting five years or more - where one party will not consent and, finally, where one party has been deserted by the other, for a period of two years or more.
