Holiday claims

If you have been injured in an accident or suffered illness while on holiday, whether abroad or in the UK, or on a cruise ship, aircraft or coach, you should be entitled to compensation.

Accidents abroad can be complex due to the language barriers and foreign legal systems, but we have a team of experienced lawyers who can deal with virtually every type of holiday accident claim.

Examples of holiday claims we have successfully pursued
  • Injuries sustained as a result of tripping on defective flooring in a hotel.
  • Injuries sustained due to slipping on wet floors.
  • Cuts sustained on defective ladders and tiles in swimming pools.
  • Injuries resulting from taking part in sporting activities.
  • Injuries sustained in road accidents.
  • Injuries sustained while skiing.
  • Illness due to food poisoning or poor standards of hygiene.

Package holiday claims

It is possible to claim compensation for injuries sustained while on a package holiday, and the regulations cover most organisers and tour operators.

To bring an action under the regulations you have to meet the following criteria:

  • The holiday was booked as a pre-arranged holiday, sold at an all inclusive price.
  • The period of the holiday must be at least 24 hours or include an overnight stay.
  • The holiday must have at least two of the following:
    • Travel
    • Accommodation, hotel or apartment
    • A tourist service or activity (for example golf, hill-walking) not directly linked to the transport or accommodation, but making up a significant part of the package.
